July 16 (Reuters) - U.S. trade regulators have launched a probe into Samsung Electronics' (SSNLF.NaE) memory chips and products sold by Google, Nvidia (NVDA.NaE), Broadcom (AVGO.NaE) and Super Micro Computer (SMCI.NaE) that use them following a complaint by Netlist (NLST.NaE) alleging infringement of its patents. California-based Netlist (NLST.NaE) has accused Samsung and its U.S. units of infringing its patents on dynamic random access memory, a type of chip that temporarily stores data for processors and is a critical component in the servers powering the AI boom, the U.S. International Trade Commission said on Wednesday. Netlist (NLST.NaE) has asked the USITC to block imports of the disputed chips and products and order the companies to stop selling them in the U.S. An ITC judge will hold an evidentiary hearing and issue an initial ruling, subject to review by the commission. The USITC will set a target date for wrapping up the probe within 45 days. Any order it issues takes effect immediately and becomes final after 60 days unless the U.S. Trade Representative overrides it on policy grounds. The investigation is the latest escalation in a years-long patent fight between the companies over high-performance memory. A Texas jury had awarded Netlist (NLST.NaE) $118 million from Samsung in 2024 over data-processing technology in memory products, following a $303 million verdict in a related case in 2023. Demand for memory chips has since surged as big U.S. technology companies race to build out data centers needed to power AI services, driving up prices of chips made by the likes of Samsung, SK Hynix and Micron. NLST isn't on the list because the screen evaluates operating businesses, and Netlist's value driver isn't its operations, it's the courtroom. The operating business is \~$265M TTM of memory-module resale at razor-thin gross margins with roughly zero EBITDA and about -$26M free cash flow, funded by years of share issuance. That fails both archetypes on contact: nowhere near the 50% gross margin bar for asset-light, no operating leverage for scale-economics, and the dilution history is exactly what the per-share filter exists to catch. The real story is the patent war, and credit where due, it's been going well: $866M in jury verdicts across Samsung ($303M + $118M) and Micron ($445M), and the Federal Circuit has now upheld two key patents on appeal (most recently Feb 2026), which is genuine momentum. But none of that money has been collected, appeals are still live, and Micron can seek Supreme Court review. So at a \~$970M cap on \~$10M of tangible book, you're buying a litigation outcome, not a compounder. Could it pay off big? Sure. That makes it an event-driven special situation, a completely different kind of bet with binary outcomes, and this screen deliberately doesn't score those, same reason it cut a $1.6B graphene company with $43K of revenue. Lottery tickets can be +EV and still not be compounders.
