It's funny to see dumb people in crypto trying to wrap their heads around things that traditional banking and finance has understood for years. Literal basic concepts that you learn if you get a job sweeping the parking lot at a bank. Where I'll agree with you is that reserves themselves aren't the only story. Risk controls, asset segregation / custody, compliance and other factors are also important. It's also important to go back to square 1 with FTX. CRIMINALITY. They seem to have knowingly been using clients to prop up other business lines. They have been accused of using Alameda to frontrun listing on FTX. Those are just 2 patently illegal things they may have done. Pretend you understand reserves, you don't. Pretend you understand risk control, you don't. Pretend you have a coherent answer, you don't. But ultimately CRIME is CRIME. FTX and it's hundreds of subsidiaries are increasingly looking like a criminal enterprise on some level which trumps everything... because it's illegal.

I think you're confusing two very importantly different things here: * 1) The TAX issue. If he doesn't pay taxes on that, the IRS will be all over his ass. Him saying he invested it in 2015 won't matter, because even if that were true, he'd still owe tons of taxes on it and would still blatantly be in violation of tax laws if he didn't pay all that tax. In the event that the income tax would have been higher than the capital gains tax, he will also need to prove that it was capital gains to get out of paying the higher amount of tax. Which he won't be able to do since he has no receipt. So the IRS would eat him alive on that. * 2) The CRIME issue. Let's say for sake of argument he paid all his taxes, and that he even voluntarily paid the income tax rate just to defuse any argument with the IRS over receipts. We still have the second issue: the fact that investigators simply don't believe him, and are now keenly aware he's a criminal. They don't need to convince a jury about this, all that matters is their own hunches, because reasonable hunches is basically all you need for search warrants and subpoenas and this will motivate them to dig into his past looking for the actual evidence of the original crimes (drug offenses, gang violence, etc). They will probably find some such evidence, and then he will face criminal charges on THAT. A huge part of laundering money is defusing any SUSPICION even that you might be a criminal, such that the police don't choose to investigate you. That's again, a mere hunch-level threshold, not a beyond reasonable doubt threshold, you need to worry about.
