They sure are, but a very excellent tool overall. If you're not already, get into using them against your commons port. Very big returns even just being semi-active, and you can keep exposure to general market and equities you like (or want to get into). It's a much slower (and boring, for us here) burn but also a lot smarter. Toss your megamillions lotto ER's out once in awhile and have a little fun. This round I had decent lotto payouts on BOX and AMSC, set money on fire with ASAN. ASAN unironically kept me out of GTLB because it's otherwise one I would have structured some kind of bullish-leaning lotto on.

Penny program rebates are much lower. They top out at .50 (BOX) and .39 on EDGX and ARCA. It is possible to see orders that are resting in the COB, but you need a broker/service that provides it. I can see the COB in my platform (WEX). I don't believe IB offers that, but I could be wrong. When you ask is IB checking multiple exchanges, they would have to actually submit the order to see if it was filled. There are no actual quotes on spreads by MM's in the COB, they interact with the spread after it is entered. You can set the IB Smart Router for max rebate, but that will potentially affect your fill quality. They don't make it easy to quickly change the smart routing criteria. Thats why I like manually sending the order to the CBOE first, which again is difficult with IB due to their extra direct routing fee. Suggest you play around a bit with the Smart router settings to see how it affects the fills on the stocks you trade.

I trade spreads quite a bit and rebates can add up. Generally, MM's cant rest orders in the COB, so when you enter a spread order, you are usually going to be adding liquidity and trading with a MM, unless there is a resting customer order in the COB. This is important, because if your contra is another customer, you most likely won't get a rebate even if you are adding liquidity. Rebates depend not only on the exchange but also if the stock is in the penny program (options can be quoted in pennies). The highest non penny rebates in Complas orders (for adding liquidity) are at the BOX (.90), EDGX, ARCA (.75), ISE (.50) MIAX (.40). These would be per contract, per leg rebates. So if you did 1 butterfly (4 contracts) on the ARCA, you would get back 3.00 Often you will not get as good as a fill on an exchange that offers a rebate. What I will typically do is send a 1 lot order to the CBOE first (no rebates charged or given to customers) to establish the best price. I will then send the order to the EDGX or ARCA to see if I can be filled at the same price and get the rebate. If you use IB, this will be harder as they charge a $1 fee for direct routing, so you have to depend on their smart router. As mentioned, certain proprietary products such as SPX and VIX are not eligible for rebates (other than some volume rebates). Remember that when you enter a spread and it is sent to an exchanges COB, it is looked at and filled as a spread, usually by a MM. It is not taking the individual legs and filling the spread on its own (except in rare situations). For the COB to "auto fill" a spread (automaitcally taking both sides of the quoted market), it would be necessary for both sides of the market be on the same exchange that the spread was sent to and no MM wanted the spread at a lower price.

So the synthetic stock trade is almost always better absent any dividends (which SVIX produces none.) Going back to SPY however, I'm not finding any way to officially treat them as section 1256 on Green Trader Tax's website at this time, so likely the fund is safer in using SPY options. SPY options still risks straddle rules and heartbeat trades is definitely a "grey" area in that [even Vanguard reports total unrealized gains of VTI being 56.73%](https://investor.vanguard.com/investment-products/etfs/profile/vti#distributions) So there's going to be risks of *any* etfs that use heartbeat trades to wash away gains that they would of had to distribute if they were a EOD mutual fund, even VTI. However, given the long track record of VTI doing this loophole, and that capital gains taxes *are still being paid*, they're just being *deferred*, eventually the IRS will get their capital gains taxes. Quite honestly the old mutual fund accounting made individual stock portfolios way superior. Previously outgoing investors who sold their shares realized their gains, then any gains realized by the fund selling it hit the rest of the participants, ouch. Honestly I think its a pretty "safe" bet that the fund will be able to continue doing this. It's not absolutely guarenteed but similiar mechanisms exist elsewhere in the tax code - such as intentionally defective non-grantor trusts have the power of subsitution to swap out different tax lots. This is essentially the heart beat mechanism in practice - since BOXX is not only a trust as a RIC - they're using the power of subsitution through heart beat trades so the actual investors who sell their boxx shares get hit with the capital gains and so on. So its also not a fund doing *tax evasion*, but *tax avoidance*, and if the IRS wants to hit BOXX hard it has two avenues: straddle rules or changing the entire tax code. Straddle rules won't hit VTI, but could hit BOXX. I'm also not a tax expert at all and while I feel I have a good essence on straddle rules - given BOX doesn't hold to expiration - they're always subject to interest rate risk, which might be enough to slide, even if interest rate risk is tiny on 26~ dte options, its still subject to interest rate risk. ;) The other way the IRS can attack BOXX is going after trust funds power of subsition - a much bigger uphill battle. If the IRS mounted a successful challenge on that - that will also equally affect VTI's heartbeat trades. That seems doubtful as it'd get a lot of investors and a huge tax base with congress writing. Quite frankly the previous mutual fund having to recognize capital gains of exiting investors was pretty sucky tax policy too. It didn't benefit any large ($1m-$5m+) investors that could do direct indexing as those investors wouldn't ever have to sell on a cap weighted index unless the index itself changes (S&P 500 committee vs 100% total market strategies.) Even then, index changes usually sell losers and buys winners - so most likely on an index change direct indexers are harvesting losses LOL! Ultimately the only case I can see where they have to start paying out capital gains is if volume drops to 0. If volume drops to 0 there is no creation or redemptions, no one selling or buying BOXX, and no power of subsitution/heartbeat trades, then the fund will have to start paying out capital gains. The fund can defer those cap gains to EOY though unlike dividends, so its still superior than SGOV where they issue dividends every month (assuming both have the same yields which might not be the case with box spreads! BOXX: 5.56%, sgov: 5.27%) They might not want to though as it'll leave other investors holding the bag like mutual funds do at end of year. I really don't think BOXX will ever drop down to 0 volume, there are too many people using it for short term holdings, emergency funds, traders using it for excess cash, etc.
