I could be wrong but when sending to cold wallet its same as a taxable event no?? Like how is it distinguishable between a wallet YOU own and another wallet you SOLD to ?? I have included the end of year printout from every exchange showing the value when purchased and when transferred so doesn’t that mean the taxes have been accounted for ?? Then its just the difference between the value on the day transferred compared to value on day sold ( also in USA there’s long term holdings va short term gains ) please tell me if I’m wrong as this is how I’ve been moving forward

Every swap you made is a taxable event. When you swap from token A to token B, the IRS thinks you've done two transactions: You SOLD token A for $X (and realized gains or losses). You BOUGHT token B for $X (and locked in your cost basis for those tokens) So once you swapped from randomprofitcoin to stablecoins, you locked in your short-term gains, and those profits will be considered income. If ETH are where those gains are right now, you need to hold them in ETH for a year from the date of that last swap for any profits to be long-term capital gains. Tl;dr you've already locked in short-term gains for US tax purposes. But at least you have profits to tax!

Not surprised one bit. I tried using Kraken back in 2021 but the CEX did not support ACH transfers so ended up moving on to other CEXs. Used [Binance.US](https://Binance.US) for a while until it's recent demise.... Forced me to take another another look at Kraken and was pleasantly surprised it now supports ACH. SOLD!!!! Also Kraken has been a longtime favorite CEX of this subreddit. Seems to be well received by a lot of members here. The recent news of them possibly listing Moons is a cherry on top!

Yeah, no. Ledger has always been advertised as a trustless-ish device. Trustlness in that my seed phrase is never exposed to any system under your control, period. You could put in firmware update out to take control of my buttons and force a confirmation of transfer of my seed phrase. That is trivially easy to accomplish. The buttons trigger a software "on press" command to the UI. That is code that can be triggered with any malicious firmware update. Even if you can finagle a way of explaining how the buttons are locked out of the system and do some special kind of electrical/hardware switch to engage the code that must be verified via a circuit breaker before the code will run, I would say, well I'll just rewrite and push out new code to undo that verification. You can push out whatever code you want. The trusted part was exclusively with using the user interface and trading systems. I don't mind that being part of your system. As long as I don't partake in it, I'm safe from your maliciousness. I can also keep my ledger offline in the event of an unsecure firmware update that might reroute crypto or something. But if my seed phrase is accessible, ever, for any reason, your code can get to my crypto, offline. My seed phrase should not have ever been accessible by you. Not even with a button press. If I want to give you my seed phrase for your recovery plan, I should have to manually input it in. That's it. That's the most obvious thing you could've done to make this OK. It's also waaaaay easier. My seed phrase should've never been stored on the ledger to begin with. Once I wrote it down, it should've vaporized from the face of the digital earth. That's it. That's what I bought your device for. That's what you SOLD ME on. You're a liar at worst and ignorant at best. See the problem is, you think the asset itself is a security. That's absurd. The Howey test is about how the asset itself is sold. Not the asset itself. Otherwise, it would be a security in secondary markets. Anything can be SOLD as a security. Perhaps some of the sales of ETH could be classified as a securities transactions, but the asset itself is not a security. You obviously don't know much about securities law. You even misspelled Howey. And that's where Gary Gensleriss overreaching. He claims these assets themselves are securities, because then he has complete control over the market. And if you're backing Gary gensler here, youre supporting the destruction of a truly free market. The crypto market would become the exact thing that it sought to replace. This makes absolutely no sense. Securities are products that are SOLD to a customer with the sole purpose of a profit attached to it. A chicken can be sold as a pet or to lay eggs for you the buyer to consume, so there is no clear profit motive in the sale of a chicken. However a staking product is sold for one reason and one reason only, with the goal of the buyer to make a profit. Which makes it a security

I bought ADA at 3c and actually SOLD last year at $2.56 realizing profits of 6 figures. YES profits. They are called profits because you actually sold something to make them.
